Agency Worker Directive and Regulations 2010
A draft version of the official guidance on the Agency Workers Regulations has now been published.
On 21 January 2010 the Agency Workers Regulations 2010 were laid before Parliament and will come into force on 1 October 2011. BIS have published draft guidance ahead of finalised guidance, due to be published on Business Link at the end of April or soon after.
The Agency Worker Regulations (AWR) and implementation of the Agency Workers Directive is the most significant legislation ever to hit the UK’s private recruitment industry. Following many years of debate in Brussels, the Regulations will come into force in England, Wales and Scotland on 1 October 2011 and are designed to give temporary agency workers parity in pay and employment conditions as they would have been entitled to had they been recruited by the hirer directly to do the same job after 12 weeks’ of service with the same hirer, in the same role, in order to qualify. Church International, as members of the REC and APSCo, has access to comprehensive AWR Implementation information and is best placed to advise and reassure our Clients about the impact and practicalities involved in the implementation of equal treatment for agency workers.
